These terms and conditions of service represent the agreement between you and GPSLive services and related products, including all hardware offered by REM Trading LTD. - GB219306813, also known as Rewire Security.
General Terms of Usage: GPSLive and Rewire Security does not allow hidden GPS tracking. You cannot use our services to track a person or their vehicle without their consent. You cannot track an object without their owner permission; You cannot use GPSLive tracking services where such actions are illegal.
It is only your responsibility to make sure that your use of GPSLive real-time tracking does not violate local or national laws. You cannot send automatic requests to GPSLive or try to mislead GPSLive authentication system, try to reverse engineer our software and be involved in such activities which would damage our systems. GPSLive accounts are non-transferable, and subscription funds are not refundable for active accounts.

CONTRACT FOR THE SUPPLY OF PRODUCTS AND SERVICES
The display of goods on the Rewire Security site and GPSLive site amounts to an invitation to treat only and is not an offer to sell products or services at any price indicated. No contract for the supply of products or goods will be deemed to exist between you and Rewire Security unless, and until, an email is sent by Rewire Security to you confirming that your order has been accepted and payment has been successfully made. This confirmation e-mail amounts to an acceptance by Rewire Security of your offer to buy goods or services from Rewire Security and this acceptance is effective regardless of whether or not you receive the e-mail. Rewire Security is free to withdraw from a prospective contract at any time prior to acceptance. This also applies in the case of any error or inaccuracy in respect of the goods or services, any description applied to the goods or services, the availability of the goods or services, or the order itself. Price and availability information is subject to change without notice.

Rewire Security disclaims all such representations and warranties, including for example warranties of merchantability and fitness for a particular purpose. In addition, Rewire Security does not represent or warrant that the information accessible via this site is accurate, complete or current. Prices shown on the website are inclusive of V.A.T at the current UK rate (20% as of the 4th January 2011)

INDEMNIFICATION
You agree to indemnify and hold GPSLive, its officers, and employees, harmless, including costs and attorneys fees, from any claim or demand made by any third party due to your use of the Service and products that are part of the service. You agree not to use, or to encourage or permit others to use the services to intentionally or unintentionally interfere with or disrupt the GPSLive services or violate any applicable laws related to the access to or use of the GPSLive services. You agree not to violate any requirements, procedures, policies, or regulations of networks connected to the Services, or engage in any activity prohibited by the Agreement. Violation of the Terms of Service.

LIMIATION OF LIABILITY (GENERAL)
Except as specifically stated on this site, neither Rewire Security nor any of its directors, employees or other representatives will be liable for damages arising out of or in connection with our products and the use of this site . This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties. Partners and employees of this company may not be held liable for damages relating to either the capital cost of any equipment purchased from Rewire Security or consequential costs associated with fitting and operation of the same when issues arise from the non-availability of GSM and GPRS network coverage. It is the responsibility of the purchaser to take whatever steps necessary to establish that the necessary and appropriate network coverage is available and that the equipment works efficiently at the location intended for use. It is recommended that purchasers verify effective operation in countries outside the UK by operating a single tracker unit initially, and prior to purchasing further units. Rewire Security will happily provide full support for these testing processes. Rewire Security does not guarantee that their tracking products will operate successfully in all parts of the world. Variations in GSM and GPRS network make this impossible and accepts no liability for any loss in connection with the failure of tracking service. Every effort will be made to assist in developing the required tracking but it remains the responsibility of the customer to ascertain if network coverage and tracking are possible in any particular global location.

WEBSITE PRODUCT DESCRIPTIONS
Rewire Security reserve the right to supply equipment which may differ in appearance from items shown on the website but which have the same use, function and facility RELATING SPECIFICALLY TO TRACKING Notwithstanding any other provision of these Terms:
(1) Rewire Security accepts no liability in connection with any losses incurred by the Customer as a result of the Customer failing to follow the instructions provided with a tracking device.
(2) Without prejudice to the other exclusions and limitations in these Terms, Rewire Security’s liability in connection with any order (whether arising in contract, tort (including without limitation negligence) or otherwise) shall not in any circumstances exceed the purchase price of the goods ordered. The Customer agrees that it shall not in any circumstances bring proceedings in tort (or otherwise) directly against any employee or officer of Rewire Security.
(3) Rewire Security is not liable for any consequential losses (including without limit loss of profits, business or goodwill or loss or damage to property) arising (whether in contract, tort (including negligence) or otherwise) from use of any tracking product, including without limitation in circumstances in which the product fails to function.
(4) All warranties which would otherwise be implied into these Terms (including without limitation as to quality and fitness for purpose of goods or services) are expressly excluded. The Customer‟s sole remedies in connection with such matters in relation to goods supplied shall be in accordance with these Terms.
(5) Nothing in these Terms excludes or limits Rewire Security’s liability for personal injury or fraud.
(6) Whilst every care is taken to ensure that information given in catalogues, corresponding quotations or other documents is accurate, no responsibility is accepted for any errors which may occur therein and such documents do not constitute part of the Customer’s contract with Rewire Security (save in relation to the technical description, as provided by these Terms). In addition, Rewire Security shall not be liable for any losses caused by inaccurate information or recommendations which have been provided to the Customer in good faith.
(7) Without prejudice to the other limitations and exclusions of liability in these Terms, Rewire Security accepts no liability (whether arising in contract, tort (including without limitation negligence) or otherwise) in connection with the failure of a device to track if this is caused by lack of credit on a “Pay as you Go” SIM card supplied by the customer or any loss of data due to problems with any part of the telecommunications infrastructure on which the tracker is dependent.
(8) Rewire Security may (at its discretion) provide support in connection with the Service at the rate of £150 plus VAT per hour.

THE CUSTOMER’S ATTENTION IS DRAWN IN PARTICULAR TO THE FOLLOWING:
Notwithstanding any other provision in these Terms:-
(1) Rewire Security accepts no liability in connection with any losses incurred by the Customer as a result of the Customer failing to follow the instructions provided in relation to the installation and use of the Software.
(2) Without prejudice to the other exclusions and limitations in these Terms, Rewire Security’s liability in connection with any Equipment, Hardware, Software or GPSLive access (whether arising in contract, tort (including without limit negligence) or otherwise) shall not in any circumstances exceed the value of the licence fee most recently paid by the Customer to Rewire Security. The Customer agrees that it shall not under any circumstances bring proceedings in tort (or otherwise) directly against any employee or officer of Rewire Security.
(3) Rewire Security is not liable for any consequential losses (including without limitation loss of profits, business or goodwill or loss or damage to property) arising (whether in contract, tort (including negligence) or otherwise) from the use of the Equipment, Hardware, Software or GPSLive access, including without limitation in circumstances in which data is lost or tracking is not successful due to a fault with the Software or GPSLive. The GPSLive website remains the property of Rewire Security and can only be used by customers who have purchased tracking credits through Rewire Security.
(4) All warranties which would otherwise be implied into these Terms (including without limitation as to quality and fitness for purpose of the Service) are expressly excluded.
(5) Nothing in these Terms excludes or limits Rewire Security’s liability for personal injury or fraud.
(6) Whilst every care is taken to ensure that information given in catalogues, corresponding quotations or other documents is accurate, no responsibility is accepted for any errors which may occur therein and such documents do not constitute part of the Customer’s contract with Rewire Security. In addition, Rewire Security shall not be liable for any losses caused by inaccurate information or recommendations which have been provided to the Customer in anticipation of an order which has been provided in good faith.
(7) Without prejudice to the other limitations and exclusions of liability in these Terms, Rewire Security accepts no liability (whether arising in contract, tort (including without limit negligence) or otherwise) in connection with the Service to collect tracking data which is caused by lack of credit on a “Pay as you Go” SIM card or any loss of data due to problems with any part of the telecommunications infrastructure on which the tracker is dependent.
(8) Rewire Security has no liability under these Terms in relation to loss or damage resulting from failure to track occasioned by the failure of any wireless device to perform its function.
(9) Rewire Security accepts no liability whatsoever in connection with the use of the Software on devices which do not comply with the minimum specifications stated in these terms.
(10) Magnetic trackers are supplied with strong industrial magnets which have been tested to support the tracking device if properly fitted. The customer is responsible for where and how the product is fitted. Rewire Security is not liable if the device is lost or damaged.

REFUND & RETURN POLICY
If you are not 100% satisfied with any GPSLive software, apps, subscriptions or products, please contact us within seven days of your purchase to receive a refund. Your refund may be subject to a processing charge of either £25 or payment for the first month of service (calculated at the Monthly Subscription rate), whichever is less. Refunds requested more than 7 days after your initial purchase date will not be issued unless the transaction was the result of a fraudulent purchase. If you are issued a refund, it should appear on your credit card or PayPal statement within 72 hours upon us notifying you. After receiving your refund, you agree to uninstall and stop using any GPSLive software product(s) for which you no longer possess a valid license for. Your GPSLive account will be disabled, and subscription may be terminated. GPSLive reserves the right to disable server, account, product keys or serial numbers issued for the refunded products.

CHANGES TO TERMS OF SERVICE
GPSLive has a right to change this Agreement at any time for any reason and post it on GPSLive website without prior notification. If you use GPSLive service after a modified Agreement, it possesses an acceptance of the new Agreement.

REGARDING INFORMATION WE COLLECT
GPSLive respects your privacy - all information that we gather is used exclusively for giving a reliable service to registered users. Especially: GPSLive does not market or otherwise reveal your information to third parties; Your information gathered within GPSLive is not used to target ads; GPSLive does not interrogate your location data without your authorization.
We collect the minimum of information, which is required only for GPS tracking. Such as Username, password, e-mail address and IMEI number of the tracking devices, SIM card numbers are used to authorize and identify our users. Our user's passwords are irreversibly encrypted before being stored in our database and encrypted with an SSL certificate. We do not gather simple text passwords; the E-mail address is only used for informing GPSLive users of our company changes in service and for resetting passwords; GPS location data which is sent by your GPS tracking device or your mobile device when you use GPSLive GPS tracking software. We pass on the following data: your GPS coordinates, latitude, longitude, speed, altitude, heading, current time, various sensor parameters. We do not pass on your phone contact lists or data stored on your mobile device.

REGARDING SECURITY
Your data which you provide to GPSLive is stored on secure servers. Our company has taken further actions to prevent unauthorized access to your data, including an SSL certificate, running firewall software and keeping our servers up-to-date with security patches. However, we cannot guarantee nondisclosure of personal information due to factors beyond our control. If you believe that your account has been hacked, please contact us as soon as possible.

REGARDING COOKIES
GPSLive uses cookies exclusively to identify the user during login process and for storing preferences. A "cookie" is a small text file that may be used to collect information about website activity. Some cookies and other technologies may recall personal information previously provided by a web user. Majority of our cookies expire as soon as you log out or close the browser window.

REGARDING GPS TRACKING DATA AND HISTORICAL LOCATION DATA
Tracking history held on GPSLive servers will be maintained on the server only so long as the tracker is active/live/in use. Inactive trackers may be removed from GPSLive occasionally and entirely at the discretion of Rewire Security.
It is solely the responsibility of the tracker user (customer) to save their tracking location data history using the file export facility on the history page of their mapping panel. Rewire Security has no liability under these terms for tracking history lost or deleted from GPSLive.
We store user location data in complience with the GDPR and safe keep this data in secure servers.

SERVICE AND GSM NETWORK AVAILABILITY
GPSLive reserves the right to carry out regular maintenance of its software, which may affect the availability of the Service. Rewire Security will use its reasonable endeavors to ensure that apart from scheduled maintenance, the panel is available for use at all other times.
GSM Availability depends on respective carriers depending on your location, GPSLive does not guarantee uninterrupted cellular service as the company does not have any control over GSM services provided by third parties.

ACCEPTABLE USE
The Service may not be used for any unlawful, fraudulent or abusive purpose and must be used as required by all applicable laws. The Customer indemnifies Rewire Security in relation to any legal liability which may be incurred purely as a result of the Customer’s use of the Service. The Customer may allow third parties (including its employees and contractors) to access the online tracking service, but this will be at the Customer’s own risk. Access will be subject to the user agreeing to Rewire Security’s terms of use from time to time as published on the website from which the online service is provided to the Customer.

UPDATES TO THIS POLICY
GPSLive and Rewire Security products and services are offered by REM Trading LTD. We are committed to upholding the eight Data Protection Principles of good information handling practice. It is our company right to update this policy from time to time without prior notification.
